What Vape Products Can Be Sold in Ontario Vape Shops and Convenience Stores
Vape retailers in Ontario do not all operate under the same product rules.
A registered specialty vape store can carry a different assortment than a convenience store, gas station or other general retailer. That difference affects everything from the flavours a store can stock to how vaping products can be displayed inside the business.
For retailers, this makes product selection more than a question of which brands or formats are selling well.
Before ordering disposable vapes, closed pods, e-liquids or other vaping products, the retailer first needs to understand what their type of store is permitted to sell in Ontario.
The biggest distinction comes down to whether the business operates as a registered specialty vape store or a non-specialty retailer such as a convenience store.
This guide explains how those rules affect vape inventory in Ontario and what retailers should check before bringing new products into their stores.
This guide covers non-cannabis vaping products and reflects the requirements addressed in this article as of September 2026. Retailers should continue to confirm federal, provincial and applicable municipal requirements as regulations change.
What Is the Difference Between a Vape Shop and Convenience Store in Ontario?
Ontario places additional restrictions on flavoured vapour products sold through retail locations that are not registered specialty vape stores.
Registered Specialty Vape Store
A registered specialty vape store has access to a broader range of compliant flavoured vapour products, subject to applicable provincial and federal requirements.
Convenience & General Retail
Convenience stores, gas stations and other non-specialty retailers can sell a narrower flavour range that includes unflavoured products and products flavoured only with tobacco, mint or menthol.
The difference is important because the restriction applies to the vapour product itself, not simply to whether the product is a disposable, pod or bottle of e-liquid.
| Product | Registered Specialty Vape Store | Convenience Store or Other Non-Specialty Retailer |
|---|---|---|
| Unflavoured vapour products | Permitted | Permitted |
| Tobacco flavour | Permitted | Permitted |
| Mint flavour | Permitted | Permitted |
| Menthol flavour | Permitted | Permitted |
| Other compliant flavoured vapour products | Permitted, subject to applicable federal rules | Not permitted |
| Disposable vapes | Permitted if compliant | Permitted only when the product meets the applicable flavour and product requirements |
| Prefilled pods | Permitted if compliant | Permitted only when the product meets the applicable flavour and product requirements |
| Bottled e-liquid | Permitted if compliant | Permitted only when the product meets the applicable flavour and product requirements |
| Vape devices and components | Permitted if compliant | Permitted, subject to applicable display and promotion requirements |
| Nicotine above 20 mg/mL | Not permitted under current federal rules | Not permitted under current federal rules |
For Ontario assortment planning, think store type first and product format second. A disposable, pod or bottle of e-liquid still needs to meet the rules that apply to the retail channel where it will be sold.
What Qualifies as a Specialty Vape Store in Ontario?
Not every retailer that sells vaping products is considered a specialty vape store.
Specialty Vape Stores Must Be Registered
To receive specialty vape store status, a retail location must be registered with the board of health for the public health unit where the store operates.
For an established location, at least 85% of total sales from the previous 12 months must come from vapour products. Different inventory or sales calculations can apply to stores that have operated for less than 12 months.
A convenience store cannot simply create a larger vape section and begin operating under specialty vape store rules. The retail location itself must qualify and be registered.
Specialty Vape Stores Are Adult-Only Environments
Registered specialty vape stores are also subject to access requirements. People younger than 19 generally cannot enter the store, apart from limited exceptions identified in Ontario's regulations.
The store must also prevent its indoor vapour product displays and promotions from being visible outside the business.
These requirements help explain why Ontario permits a broader flavoured vape assortment inside this particular retail environment.
What Vape Products Can Convenience Stores Sell in Ontario?
Convenience stores and gas stations can participate in the Ontario vape market, but their assortment needs to be built around the rules that apply to non-specialty retailers.
Unflavoured, Tobacco, Mint and Menthol Products
Ontario permits non-specialty retailers to sell unflavoured vapour products as well as products whose flavouring falls within tobacco, mint or menthol.
Other flavoured vapour products are restricted to specialty vape stores and other specifically exempt retail channels.
A product containing the word “mint” or “menthol” is not automatically convenience-store eligible. Where another flavour profile is combined with it, the individual SKU still needs to be reviewed against Ontario's requirements.
For retailers managing a large catalogue, this makes SKU-level review important.
Disposable Vapes
Ontario convenience stores can sell disposable vaping products when the individual product falls within the permitted flavour range and meets all other applicable requirements.
The fact that a product is disposable does not create a separate exemption from Ontario's flavour rules.
Closed Pods & Prefilled Pods
A convenience store can carry eligible prefilled pods and compatible devices, but the flavour contained in the pod still matters.
Device and replacement pod selection should also make sense together so customers can access compatible permitted replacements.
Bottled E-Liquids
Bottled e-liquid is also subject to Ontario's applicable flavour restrictions.
Selling the vaping substance separately from the device does not change the flavour eligibility requirements.
Devices, Coils & Hardware
Convenience retailers can carry devices and relevant hardware, but they still need to consider the display and promotion requirements that apply to vapour products.
A tobacco-flavoured disposable may be appropriate for a non-specialty retailer, for example, while another flavour from the same device line may be restricted to the appropriate retail channel.
This is why retailers should avoid evaluating an entire product platform as either “convenience eligible” or “vape-store only.” Different SKUs within the same line can have different retail eligibility.
What Can Specialty Vape Stores Sell in Ontario?
Registered specialty vape stores have more flexibility when building their assortment.
A Broader Range of Flavours
Ontario's retail restriction on flavoured vapour products contains an exemption for specialty vape stores.
That means registered specialty stores can sell compliant flavoured vapour products beyond the tobacco, mint and menthol range available through conventional convenience retail.
Federal manufacturing, packaging, labelling, promotion and product rules still apply, so specialty registration should not be interpreted as an exemption from Canadian vaping regulations.
The Federal Nicotine Limit Still Applies
There is an important regulatory detail here that can cause confusion.
Ontario's regulations were written to restrict products above 20 mg/mL to specialty vape stores. Federal rules subsequently established a national maximum nicotine concentration of 20 mg/mL for vaping products manufactured or imported for sale in Canada and prohibit the sale of products labelled above that limit.
An Ontario specialty vape store should therefore not interpret the older provincial wording to mean it can currently sell 30 mg/mL, 50 mg/mL or other higher-nicotine products.
The federal 20 mg/mL maximum applies across the Canadian retail market.
Federal Vape Rules Apply to Both Types of Retailer
Ontario's store-specific rules are only one layer of compliance.
Products also need to satisfy federal requirements before they reach the shelf.
Packaging and Labelling Matter
Health Canada regulates vaping-product packaging and labelling, including nicotine information, health warnings, ingredient information and child-resistant packaging requirements where applicable.
Legal nicotine vaping products are subject to the 20 mg/mL maximum, and applicable products are also subject to federal packaging and labelling requirements.
A flavour being permitted in your type of store does not automatically make the product compliant. Flavour eligibility is only one check.

Ontario Products Need the Appropriate Excise Stamp
Ontario participates in the coordinated federal and provincial vaping duty system.
Vaping substances and devices containing a vaping substance that are intended for Ontario's duty-paid market must carry the appropriate Ontario vaping excise stamp. The stamp helps indicate that the applicable vaping duties have been paid.
This becomes particularly important for distributors, chains and retailers operating across more than one province.
A product intended for one provincial market should not automatically be transferred into another store's inventory without checking whether the excise stamp is appropriate for the destination province.
Empty devices and other hardware that contain no vaping substance are treated differently under the excise framework because the CRA definition of a vaping product for these purposes focuses on vaping substances and devices that already contain a vaping substance.
Vape Display Rules Are Different for Convenience Stores and Specialty Vape Shops
The difference between Ontario retail channels extends beyond what can be sold.
It also affects what customers can see.
Convenience Stores
At a non-specialty retail location, vapour products cannot generally be displayed in a way that allows customers to view or handle them before purchase.
Ontario permits limited methods of providing product and price information, subject to specific requirements.
Specialty Vape Stores
Registered specialty vape stores can display and promote vapour products inside the business when the applicable specialty-store conditions are met.
Those displays and promotions cannot be visible from outside the store.
Convenience Stores Must Keep Vapour Products Out of View
Ontario permits limited methods of providing product and price information, but the province places specific conditions around those materials.
For example, the regulation allows no more than three qualifying signs, limits their size, requires a white background with black text and graphics, and prohibits vape-brand identifiers on those signs.
That creates a very different merchandising environment than a specialty vape shop.
A convenience retailer therefore needs an assortment that employees can understand and explain without relying on a large open product wall.
For convenience retail, clear internal SKU organization becomes especially important.
Specialty Vape Stores Have More Display Flexibility
A registered specialty vape store can display and promote vapour products inside the business when the applicable specialty-store conditions are met.
Those displays and promotions cannot be visible from outside the store.
For specialty retailers, the ability to organize products visibly by format, brand or compatible system can create a very different shopping and inventory-management model from the one used in convenience retail.
How Ontario Retailers Should Build Their Vape Assortment
The most reliable way to build an Ontario assortment is to avoid starting with a national catalogue and removing products afterward.
Start with the retail channel.
Build Separate Assortments by Store Type
A retailer operating both specialty vape stores and convenience locations should not use one Ontario master assortment for every location.
Instead, the specialty and non-specialty channels should have separate eligible product lists.
That makes purchasing, replenishment and transfers easier to control and reduces the chance that inventory intended for an adult-only specialty store ends up at a conventional retail location.
Review Products at the SKU Level
Eligibility should also be checked at the individual SKU level.
One device family may contain tobacco, mint and other flavoured products under the same brand or platform. The fact that one flavour can be sold through a convenience store does not mean every SKU in the line can.
This becomes particularly important when new flavour extensions are introduced after a retailer has already approved the original line.
Keep Ontario Inventory Identifiable
For multi-province retailers, Ontario inventory should also remain clearly identifiable through purchasing and distribution.
Province-specific excise requirements make uncontrolled inventory transfers a compliance risk, even when the product name and packaging appear otherwise identical.
- Destination province
- Excise stamp type
- Retail channel
- Flavour eligibility
- Product format
- Compatible replacement products where applicable
Keeping these details connected to the SKU can make replenishment easier for head-office and store teams.

Common Ontario Vape Retail Mistakes to Avoid
A Quick Ontario Vape Product Checklist for Retailers
Before adding a product to an Ontario location, retailers can work through a consistent set of checks.
- Is the location a registered specialty vape store or a non-specialty retailer?
- Is the product's flavour permitted in that retail channel?
- Has the individual SKU been reviewed rather than only the broader product line?
- Does the nicotine concentration comply with the federal maximum?
- Does the packaging and labelling meet applicable requirements?
- Does the product carry the appropriate Ontario excise stamp where required?
- Can the product be displayed or promoted in the intended retail environment?
- Are compatible pods, coils or accessories required to support the product?
- Is the product appropriate for the destination store before inventory is transferred or reordered?
Build Your Ontario Vape Assortment Around the Right Retail Channel
Ontario offers opportunities for both specialty vape retailers and convenience operators, but the right product assortment depends on where those products will ultimately be sold.
Registered specialty vape stores can carry a broader range of compliant flavoured products, while convenience stores and other non-specialty retailers need to build around Ontario's permitted unflavoured, tobacco, mint and menthol range.
From there, every retailer should still verify nicotine concentration, packaging, labelling, excise stamping and other applicable requirements before inventory reaches the shelf.
